Tulsi case: CBI opposes Vipul Agrawal's bail plea

In an affidavit opposing the bail plea of suspended IPS officer Vipul Agrawal, the CBI has alleged that an official of his rank could tamper with evidence if enlarged on bail. Agarwal was arrested by CID (crime) in connection with the Tulsi Prajapati fake encounter case before the case was handed over to the CBI by the Supreme Court earlier this year.

Agrawal has sought 'default bail' as the CBI has failed to file a charge sheet against the accused in the Tulsi Prajapati encounter case within the stipulated period of time.

He had contended that after the Apex Court handed over the case to the CBI, the central agency had registered a fresh complaint. But it had failed to file a charge sheet within the stipulated period of time. Hence he should be released on 'default bail', the IPS officer said in his petition.

Opposing Agarwal's plea for bail, the CBI has said that Agarwal cannot be granted 'default bail' as he had already been charge-sheeted in the encounter case by Gujarat police.

Tulsi Prajapati was killed in a fake police encounter in Banaskantha district in December 2006. Agrawal was SP Banaskantha at the time of the incident.
