Though the Allahabad High Court has acquitted Rajesh and Nupur Talwar in the Aarushi–Hemraj double murder case, it seems they will have to wait longer to actually return home. The couple is currently at Ghaziabad's Dasna Jail.

Aarushi, 14, and Hemraj, 45, were found murdered in May, 2008. The Talwar couple has been in the jail for over four years now.

The Dasna jail authorities had not received a certified copy of the court order until late on Friday evening. So, the couple's release procedure could not be carried out. Since the court will be shut on Saturday (second of the month) and Sunday, they will now be released on Monday.

Representing the Talwars, Adv Tanveer Mir said: "The delay is regrettable but the process tobtain a certified copy for their release orders was long. Unfortunately, the courts are off this Saturday and there is a strong likelihood that the Talwars will walk out earliest by Monday. My clients have already spent four years in jail. But, we are helpless and are duty-bound to follow the rule of the land. It is just a matter of a few more days."

Meanwhile, Jail Superintendent Dadhiram Maurya said after getting the release order, the jail authorities will take maximum half an hour to release the couple. "The certified order copy, as per the procedure, is hand-delivered. I have never released anyone after receiving the order copy via fax or e-mail," he added.

Under section 437 (a) of the CrPc, the couple will also have to sign a surety bond. This is to ensure that the acquitted accused person is present in the court, in case the state files an appeal in a higher court.
