Taj, Claridges among 166 defaulters which owe NDMC Rs 320 crore

The New Delhi Municipal Council (NDMC) is pitched in a legal battle with top Delhi hotels to get "outstanding" property dues worth Rs 320 crore. The council, in a report prepared at the end of the 2016-17 fiscal, accessed by DNA, has identified 11 five-star hotels among 166 alleged defaulters, which have dues pending above Rs 10 lakh for the last four years.

The hotels include the Taj Palace, The Park, Leela, Ashoka, Ambassador, Janpath, Claridges, Ashok Yatri Niwas, Maurya Sheraton, Samrat and Imperial. Clubs and establishments catering to the elite, like the Delhi Golf Club and Gymkhana, are also on the list of defaulters.

All the alleged defaulters have moved court, challenging NDMC's tax assessment. The Taj Palace and Claridges maintain that they have no dues pending. "The Taj Palace, New Delhi, has paid all taxes due till date," a spokesperson told DNA.

"We have cleared all dues with NDMC and no amount is pending," Asghar Ali, Group President, The Claridges Hotels, said.

According to an NDMC official, since the matter is under litigation, the Council cannot attach their assets or ask them to pay till the matter is settled. "While these properties have been paying the 'admitted' tax amount, the 'outstanding' is still due. These establishments have claimed that the assessment by the Council is not fair and hence they have approached the court. The matter is open to legal scrutiny," he said.

While the outstanding amount with Taj Palace and Claridges is around Rs 42 crore and Rs 4 crore, respectively, the Delhi Golf Club owes around Rs 700 crore. The Ashoka's outstanding is around Rs 139 crore, Imperial's around Rs 55 crore, Samrat's Rs 31 crore, Janpath's Rs 26 crore and Park and Leela owe about Rs 18 crore each.

"We have approached the court for reassessment, as the demand made was not correct. The next date is due in June," said a senior Delhi Golf Club official.

There are around 7,000 properties from which NDMC collects taxes, of which around 350 are high-value properties like hotels, clubs and some central government establishments.

The civic body has collected Rs 577 crore as property tax in 2016-17, a jump from Rs 479 crore in 2015-16. "This time, we could collect more as we had started sending notices to defaulters from January. We had issued notices to around 3,500 owners to pay pending dues," the official said.
