Supreme Court refuses to hear Mayawati's plea against EC order banning her from campaigning

Mayawati moved the apex court on Tuesday to appeal against the EC order saying it was passed without hearing her.

Slapped with a 48-hour ban on campaigning by the Election Commission for her "provocative" communal remarks, BSP supremo Mayawati on Tuesday moved the Supreme Court, only to be refused a hearing. 

The EC on Monday imposed a nation-wide ban on Mayawati, among other leaders, for their "provocative" communal remarks, which it said had the "propensity to polarise the elections". The action follows her speech in Deoband last week where she appealed to Muslim voters to not vote for Congress to avoid division in the anti-BJP votes.

Mayawati alleged that the decision appears to have been "taken under pressure" and it will be remembered as a "black day".

Terming the ban a "sudden unprecedented order based on wrong facts", she asserted that the poor and deprived sections of the society will not forget it as she was being deprived of her right to appeal to uproot the BJP from power.

She moved the apex court on Tuesday to appeal against the EC order saying it was passed without hearing her. She was to address a joint SP-BSP-RLD rally in Agra on Tuesday. 

The top court refused to hear her plea and asked her counsel to file a separate appeal against the poll panel's order.

A bench headed by Chief Justice Ranjan Gogoi expressed satisfaction over Election Commission's action against UP Chief Minister Yogi Adityanath, Mayawati and others for allegedly making hate speeches during poll campaign.

Taking note of the EC action, the court said it seems the EC has "woken up" and barred various politicians from poll campaigning for varying hours.

The bench also comprising Justice Sanjiv Khanna made it clear that no further order was required for now.

Following the SC rap for EC, the poll panel on Monday afternoon took action against Adityanath, Mayawati, Azam Khan and Union Minister Maneka Gandhi.

The bench was hearing a PIL filed by an NRI Yoga teacher based in Sharjah in the United Arab Emirates (UAE), seeking a direction to the EC to take "strict action" against political parties if their spokespersons make remarks based on caste and religion in the media in the run up to general elections.
