Speaker may reserve opinion on Congress' plea to disqualify defected MLAs

The Gujarat Congress' petition to Assembly Speaker Ramanlal Vora to disqualify 14 defected MLAs may take time to be processed. Vora said that he will think on it before processing anything.

"The petition has been received and I will study it before taking action. It requires time to come to any conclusion on such a sensitive issue. It is also necessary to take legal opinion as this kind of case has never been reported in the past," Vora told DNA.

The Congress had filed a petition on Wednesday with the Gujarat Legislative Assembly Speaker, seeking to bar its 14 former MLAs, who had either quit or cross-voted in the Rajya Sabha elections, from contesting elections for six years.

"If the process takes time and the term of the Assembly expires before that, the petition may be treated as null and void. Moreover, the Congress has the right to challenge my decision on this petition in the Supreme Court," he added.

However, sources said that Vora may not admit the petition before the next Assembly elections. It is also possible that he may dismiss this petition on several grounds.

The BJP-led Gujarat government has been rejecting such grounds, in which MLAs can be disqualified. This had happened when Congress leaders had said before the Rajya Sabha polls for three seats in state, that party MLAs defying the mandate should be disqualified for six years from contesting the polls as per the Representation of People's Act(RPA).

The Minister of State for Parliamentary and Legal Affairs in Gujarat government Pradipsinh Jadeja had said that the Congress was spreading a myth under the camouflage of the RPA and there was no such provision to disqualify the MLAs under such circumstances.
