Sohrabuddin Sheikh encounter: Case against Gulab Chand Kataria politically motivated: BJP

BJP on Friday accused the ruling Congress of "misusing" CBI against its rival parties and said that the case filed against Leader of Opposition in Rajasthan Assembly Gulab Chand Kataria in the Sohrabuddin Sheikh encounter case was "politically motivated".

"If people will leave the public life considering the CBI charge sheet is true, then nobody apart from Congress will survive. Neither DMK nor SP (Samajwadi Party) or BSP will survive. Nobody will survive. This government has the nature of threatening the other parties with CBI and saving its people from the CBI," Former Gujarat Home Minister and BJP General Secretary, Amit Shah, told reporters in Jammu on Friday.

Kataria and three others have been booked in the fake encounter case.

Sohrabbudin and his wife were allegedly abducted by the Gujarat Anti Terrorism Squad (ATS) from Hyderabad and killed in a fake encounter near Gandhinagar in November 2005.

Shah, who is also an accused in the case and is out on bail, said that it was a "farce issue" and the court will come out with the truth.

On the u-turn made by the Gujarat Government with regard to Maya Kodnani, Shah said, "Gujarat government has not taken any u-turn."

"First the SIT decided to appeal, at that point also Gujarat Government had said that Advocate General's opinion should be sought and even today the government has said that after taking the Advocate General’s opinion, a decision should be made," he added.

"Government has neither given a clean chit to anyone nor has it appealed for anybody's execution," he said.

The former state Home Minister dubbed the comments made earlier regarding the death sentence to Kodanani, who along with Babu Bajrangi have been convicted in the Naroda Patiya massacre, as "media reports".

"It is not a government report, it is a media report. We told SIT to make the decision about the appeal after taking the Advocate General's opinion," he said.
