Silver lining for 2G accused, can stall case and question CBI probe

The final arguments in the ongoing trial in the 2G scam case is starting from December 19 when CBI is likely to produce its additional prosecution witnesses. As of now it seems the trial will go on smoothly, but considering the chaos in the CBI, the possibility of some accused approaching higher courts seeking fresh probe cannot be ruled out.

The CBI chief Ranjit Sinha, earlier this year had allegedly tried to derail the case against Reliance Telecom ( Anil Dhirubai Ambani group) and its three accused directors in 2G spectrum allocation scam.He had stated that CBI has found some new facts in the case and wants to suspend ongoing trial and reinvestigate the matter.

However, CBI's then special public prosecutor Uday U Lalit, who is now a judge in the Supreme Court, in a strong reply accused the CBI and its director of weakening the case and demanded an explanation from the agency for such proposition.

After the SC's tough stand against the CBI director, things may move on in the 2G trial court smoothly as all the 153 prosecution witnesses and 29 defence witnesses in the main case have deposed before the court.

For accused in the 2G case, the decision could prove to be silver lining as they are now in a position to take maximum advantage of the situation and approach the higher court with the plea that the CBI investigation lacks credibility.

One of the main accused in 2G case, former telecom minister A Raja has already sought a direction to the agency that he should be supplied with copy of letters exchanged between former special public prosecutor UU Lalit and the CBI.

"Direct CBI to supply all materials with complete sequence of event for actions taken by the CBI director in the interest of justice," senior lawyer Ram Jethmalani representing Raja had told the court earlier in September.
