The Supreme Court urged Jay Shah, son of BJP president Amit Shah and a news portal to settle their dispute on Wednesday.

A bench led by Chief Justice of India Dipak Misra along with Justices AM Khanwilkar and DY Chandrachud said: “See if it can be resolved. Let Senior Counsel (Kapil) Sibal and (Neeraj Kishan) Kaul sit together and talk.”

Sibal is representing Rohini Singh, the journalist and the Editors of the news portal, whereas Kaul is arguing for Shah.

The court, which was hearing the defamation suit filed by Shah against the news portal over an article published by them titled ‘The Golden Touch of Jay Shah’, then adjourned the matter till July asking the counsels to sort it out.

At the previous hearing, the apex court had issued notice on a petition filed by online news site The news portal seeking to quash the defamation charges filed against it by Shah.

The three-judge bench had directed the trial court in Ahmedabad – where the charges have been filed, to suspend proceedings while the matter is pending in the top court.

Then Kaul had suggested that The news portal‘s October 8, 2017 report, ‘The Golden Touch of Jay Shah’, amounted to “scurrilous reporting.”

However, responding to these allegations, Sibal said that the media had a right to question and call out on business affairs of individuals that are of public interest. “If journalism is going to be throttled like this, no journalist can ask questions,” he said.

CJI SPEAKS

CJI Dipak Misra, while stressing that he was not commenting on the merits of the case, suggested that there were times when journalists wrote in a matter that amounted to “sheer contempt of court”
