SC to hear plea for probe in Judge Loya case today

Last hearing saw heated argument.

The Supreme Court will today hear the plea filed by three petitioners seeking a Special Investigation Team (SIT) probe in the alleged mysterious death of Special Central Bureau of Investigation (CBI) Judge B H Loya.

A bench, headed by Chief Justice of India (CJI) Dipak Misra, will hear the petitions. The top court had asked the Maharashtra government, earlier in the month, to submit the postmortem report of the CBI judge, who had died in alleged suspicious circumstances in 2014, citing that the "matter was very serious."

According to reports, Maharashtra-based journalist Lone and activist Tehseen Poonavala had filed independent pleas seeking a fair probe into the death of Justice Loya, who was hearing the Sohrabuddin Sheikh fake encounter case, involving various police officers and Bharatiya Janata Party (BJP) president Amit Shah. In a press conference held on January 12, Justices Madan B. Lokur, Kurien Joseph, Ranjan Gogoi and Jasti Chelameswar questioned the conduct of the CJI, alleging that selective Benches were being appointed to preside over certain cases in the apex court. Justice Loya's death is one among the certain cases hinted by the four judges.

The Supreme Court, hearing a plea seeking an independent probe into the death of special CBI judge BH Loya, disrupted in mayhem and chaos during the last hearing as the bar and the bench got into a heated exchange with each other.

Justice DY Chandrachud, who was one of the three judges on the bench hearing the matter was forced to wade after an argument erupted between senior advocates Dushyant Dave and Pallav Shisodia. Justice Chandrachud lashed out at Dave saying "you shall not shout me down. You shall listen when a judge speaks to you."

As tempers flared, Dave refused to be cowed down and heatedly responded, "I will not listen to you." The two-hour hearing had begun in a relatively peaceful manner with senior advocate V Giri - representing Congress supporter Tehseen Poonawala, suggesting that Maharashtra had conducted an "armchair inquiry" and going on to pointing out all the contradictions in the report on the judge's death.

Halfway through the hearing, Dave submitted that he would file an application seeking a cross-examination of the 11 witnesses who were featured in the report that was being picked apart by Giri before a bench led by Chief Justice of India Dipak Misra.
