SC refuses sale and transport of firecrackers outside NCT

The apex court further directed the Central Pollution Control Board to prepare an inventory of existing firecrackers with at least 450 traders in NCR and suggest measures for their disposal

Around 100 firecracker traders on Friday approached the Supreme Court with a hope to move their existing stock — which has been lying idle since the ban on firecrackers — by selling it outside the National Capital Territory (NCT). However, the apex court declined their request and refused to lift the ban on the sale and transportation of firecrackers in the National Capital Region (NCR).

“We cannot allow you to transport the firecrackers outside the NCR region to sell or dispose it of and increase the pollution levels there,” a bench led by Justice Madan B Lokur said.   

The apex court further directed the Central Pollution Control Board (CPCB) to prepare an inventory of existing firecrackers with at least 450 traders in NCR and suggest measures for their disposal.

Senior counsel Rajeev Dhawan, appearing for 68 traders, informed the court that FIRs are being lodged against merchants whose licences were cancelled due to the ban but they were still stocking firecrackers. Dhawan sought relief against any coercive action for the traders.  

Meanwhile, CPCB informed the court that based on an analysis on some samples of firecrackers, it was found that commonly used chemicals in firecrackers exceeded some of the prescribed parameters. This, it said, may have adverse effects.  

In response, senior advocate Salman Khurshid, appearing for some of the manufacturers, submitted that his clients were willing to follow the guidelines as prescribed by the appropriate agencies.  

“Not all firecrackers create pollution. We can amend substitute and amend the composition of chemicals, if we know what is prescribed limit,” Khurshid said.
