Hasty implementation of GST: Rajasthan High Court sends notice to Centre, State

Rajasthan High Court has issued a notice to the State and Central government seeking an explanation over the hasty implementation of Goods and Service Tax (GST). The notice was issued on Wednesday during a hearing of a writ petition filed by an association of tax consultants demanding stay on GST. The issue concerns thousands of businessmen and industrialists across the country and court has sought clarification from the government before the next hearing scheduled on September 13.

Sighting various issues faced at the GST portal, the tax consultant association had approached the court for relief. Pleading at the court, the association lawyer Sanjay Jhanwar said that government is thrusting 'clinical trial' without developing 'proper infrastructure' for the sophisticated GST procedures.

"Technical glitches on GSTN portal and resultant issues expose the businessmen to penalties under the GST law," said advocate Jhanwar apprising on the difficulties faced by the taxpayers. "It's like a clinical trial of the new system on cost, hardships and perils of the taxpayers," he added. Adaptation towards GST has become an impasse task for the businessmen and consultants, more due to lacuna on part of implementation than due to the unwillingness of taxpayers. As per sources, only a quarter of the GST returns for the month of July have been filed and the government keeps extending the deadline for filing return.

"The returns can only be filed over the web portal which is full of shortcomings, hours and hours of an attempt to upload data on the website fail and the returns remain pending," said Sanjay Agarwal, a senior tax consultant. "Only solution to these the government has, is extending the deadline but they do not take in account the difficulties that taxpayers face in the process," he added.

The Tax consultant association though has clarified that they are not against implementation of GST and even support it.
