Rajan Welukar issue: Supreme Court rejects plea by ex-pro vice chancellor

The Supreme Court on Tuesday refused to hear a plea to set up a search committee to re-verify the eligibility of Mumbai University vice-chancellor (VC) Rajan Welukar and also to vacate the stay granted by it earlier on Bombay high court's order.

The Supreme Court on Tuesday refused to hear a plea to set up a search committee to re-verify the eligibility of Mumbai University vice-chancellor (VC) Rajan Welukar and also to vacate the stay granted by it earlier on Bombay high court's order.

A bench headed by chief justice of India HL Dattu said the application will be taken up for hearing along with Welukar's petition in July. Former pro-VC AD Sawant moved the application.

Sawant's counsel Jayant Bhushan, assisted by Dilip Taur, submitted that the application would become infructuous since Welukar's five-year term ends on July 7. The bench said this is "not a matter to be taken up this side of vacation and will be decided in due course".

"The court can also go into the issue of qualification even after his retirement and if found disqualified, he will be blacklisted from academic field," the court added.

Welukar, who was restrained from discharging his duties as Mumbai University Vice chancellor following the high court's order to reconsider his eligibility criteria, had moved apex court seeking quashing of high court order.

Welukar, who was appointed as VC in July 2010, challenged the December 11, 2014 and February 11, 2015 orders. The Bombay high court in its February order had directed the university and chancellor to place the issue of Welukar's eligibility before the Search Committee for reconsideration.

In his plea, Welukar stated that neither the Maharashtra Universities Act nor the statutory order provides for reconsideration of eligibility criteria of a selected candidate and "nor is there any provision for constitution of a new search committee for reconsideration, and therefore, the entire exercise would be without any legal authority."
