Raids at 22 places to unearth Rs 1,000 crore benami deals

More than 26 cars carrying 100 tax officials raided and surveyed the premises across Delhi and National Capital Region -- Gurugram and Rewari.

The Income Tax (I-T) officials stormed 22 premises of prominent businessmen, real estate agents and son of Rashtriya Janata Dal (RJD) MP P C Gupta in Delhi, Gurugram, Rewari and a few places in New Delhi to collect evidence against benami land deals linked to RJD supremo Lalu Prasad Yadav and his children -- Tejashwi Yadav, Tej Pratap Yadav and Misa Bharti.

More than 26 cars carrying 100 tax officials raided and surveyed the premises across Delhi and National Capital Region -- Gurugram and Rewari.

"This is the part of our investigation, and it is connected to Lalu Prasad about the benami land deals and cases of tax evasion as well," an I-T official told DNA, on condition of anonymity.

I-T sources also said they are collecting the evidence against alleged beneficiaries – Lalu Yadav, his son-in-law Shailesh Kumar and son of PC Gupta – in this case. Recently, Bharatiya Janata Party (BJP) had alleged that Lalu Prasad's daughter Misa Bharti, a Rajya Sabha MP, and her husband Shailesh Kumar were involved in benami land deals to the tune of Rs1,000 crore, and demanded an investigation into it.

The tax department has found some documents that identify a person named Vivek Nagpal as a key link in the alleged benami land deal. IT official said the probe is a the preliminary stage, so they cannot confirm it.

Last week, Bihar BJP leader Sushil Modi had alleged that Lalu and his family illegally owned land worth Rs 200 crore and were constructing a mall worth Rs 750 crore on the same.

BJP Bihar unit has alleged that Yadav, his daughter Bharti and her husband Kumar bought a piece of land for Rs 1.4 crore whose actual market value is Rs 100 crore.

On October 25, 2008, the couple sold the shares of their PLT Limited to Shalini Holding, Ad Fin Capital Services and Mani Mala Delhi Properties Limited. All these four entities have been sold back to Bharti and her husband's entity at the rate of Rs 2 per share only. RJD supremo Yadav denies the existence of shell companies.

BJP alleged that RJD chief's son Tejasvi Yadav is linked to a Delhi-based benami property worth Rs 115 crore.

In 2007-08, Mumbai-based five diamond dealers gave Rs 5 crore interest-free loan to a company, KB Export Limited. KB Export has bought 800 square feet property for Rs 5 crore in the same year in a posh area of Delhi: D-1008 New Friend's Colony. The current value of this property is about Rs 55 crore. Most of the shares of KB Export with Lalu's son Tejasvi and daughter Chanda Yadav.

New Benami Property Act?

Under the New Benami Act 2016, all those who have bought property in the name of their mother, father or sibling without being a joint shareholder, now could face a sentence of seven years in jail. They will also have to face 25 per cent penalty on the rate of fair market value on the property as well. Unlike the old Act, in the new Act, the government will confiscate the property without paying any money to the benamidar.

What is a benami transaction

This is a kind of transaction where the assets are not in the name of a person who pays for the assets. Benami could be in cash, property or any transaction, tangible or intangible, movable or immovable could fall under benami transaction. Gift are not a benami transaction unless you have the proof and source of income.

Who is a benamidar?

Benamidar is a person or a fictitious person, in whose name the Benami assets has been transferred, in order to conceal the real owner.

Who is a beneficiary?

A beneficiary is a person, whether his identity is known or not, has invested the black money in the name of benamidar.

The charges
