Activist lawyer Prashant Bhushan on Wednesday moved Supreme Court seeking an order to Centre for removal of (retired) Justice CK Prasad from the post of Chairman, Press Council of India (PCI) for his alleged “official misconduct” while dealing with cases as a judge of the apex court.

Bhushan, who has already lodged a complaint with Central Vigilance Commission (CVC) and Central Bureau of Investigation (CBI) against Prasad for registration of an FIR after thorough enquiry, filed a PIL alleging both the agencies have failed to act upon his representation to them separately.
“The non-registration of a FIR or Regular Case (RC) by the CBI is in violation of this court’s earlier ruling which held registration of FIR/RC as mandatory once a law enforcement agency receives information of the commission of a cognisable offence,” said Bhushan.
Bhushan, who has raised the issue of corruption involving high profile personalities including former Telecom Minister A Raja, CBI Director Ranjit Sinha and many others through various PILs, referred to the cases which Justice Prasad had dealt with and sought immediate removal of Justice Prasad from the post as PCI.
Justice Prasad had demitted his office as a judge on July 14, 2014, and assumed the office as Press Council of India as Chairman on November 27 2014.
In his four-page complaint to CBI in December last year, Bhushan said “...Justice Prasad abused his position as a Judge of Supreme Court in order to confer huge pecuniary advantage on a private party and thus committed criminal misconduct under Section 13 (1) (d) of the Prevention of Corruption Act,” Bhushan said and sought an “impartial investigation after registering an FIR.”
The Supreme Court is likely to hear the petition soon.
