Bharat Petroleum Corporation Limited (BPCL) has served a notice to Tej Pratap Yadav, Bihar Health Minister and the elder son of RJD President Lalu Prasad Yadav, asking him to explain why the licence of a petrol pump allotted in his name should not be terminated for "violation" of its allocation clauses.

Tej, who received the notice on May 29, has been given 15 days to respond.

In the show cause notice issued to Tej Pratap and M/s Lara Automobiles, the BPCL has asked the junior Yadav to explain how he, being a minister for Health, Water Resources and Environment, and Forest departments, is carrying out obligation of personally supervising the day-to-day affairs of the dealership.

The query pertains to Clause 7 of the brochure of Dispensing Pump and Selling Licence (DSPL) agreement, according to which an applicant selected for the retail outlet dealership (of BSPL pump) will not be eligible for taking up any other employment or will have to resign from employment prior to his appointment as the dealer.

The show cause notice also mentions of receiving a complaint by one Chandra Shekhar on April 28, which alleges that Tej had falsely declared to have land for the petrol pump. "On the date of submission of the application for the retail outlet (January 12, 2012) you were neither the shareholder nor the director of the said M/s A K Infosystem, neither did it enter into any lease with you," the BPCL quoted from the complaint.

A similar allegation had been made by senior BJP leader Sushil Kumar Modi on May 5, in which he accused Tej of illegally acquiring a BPCL petrol pump in Patna, as neither he nor his family had the ownership or lease of the 43 decimal land claimed by him at that time.

Tej, in his licence application letter, claimed that M/s A K Infosystem Pvt Lt leased the land to Lalu's younger son and deputy CM of Bihar Tejashwi Prasad Yadav on January 7, 2012, besides producing two MOUs executed in his (Tej's) favour by AK Infosystem and Tejashwi on January 11, 2012, one day before applying for the licence. The pump was commissioned to M/s Lara Automobiles (owned by Tej) on February 27 this year.

The BPCL has thus sought a reply on the land related allegations made by Chandra Shekhar, along with supporting documents, and said, "The allegations in the complaints and observations are serious in nature, and if true, it may lead to cancellation of the DSPL agreement (petrol pump licence)."
