Only one talaq case at Shariat court after SC judgement

This year, since January till the SC judgement on August 22, the court had registered 118 such cases

Within a month of a historic judgement given by Supreme Court (SC) on triple talaq, the Muslim community has seen a change in their community.

The Shariat Adalat (court) in Mumbai claims the number of people coming with triple talaq complaints has seen a significant decline.

This year, since January till the SC judgement on August 22, the court had registered 118 such cases. While since August 23 till date only one legal talaq case has been registered.

Khatoon Shaikh, Qazi at Shariat Adalat, said, "It is amazing to see that after the judgement passed by SC the number has gone down incredibly. Every month we get at least 10 cases. This is first time that we got one in 20 days."

The talaq case has been filed by a 24-year-old Bharat Nagar resident because his wife is not ready to take talaq orally which he gave a month ago in front of their family members before the judgement.

"They have a marital dispute due to which he wants to give talaq to his wife. They have been married for four years. While the wife stays with her parents, she is not ready to accept the oral talaq," said Tameeza Sayed, member of Bhartiya Muslim Mahila Andolan.

While a week ago, the husband visited the Shariat court to register a case, the first hearing of the case was on September 11, Monday.

"The husband has registered a legal divorce case and wants to take a divorce legally. We called both the parties together to listen to their case. While the husband is firm on getting a divorce from his wife, he is ready to pay the maintenance fine," said Shaikh.

The next hearing is to be held next week. "The wife wants some time to decide on the maintenance amount to get a divorce. Next week, the maintenance amount will be fixed and further process will be started," said another member from the Shariat court.

Besides the talaq cases, the Shariat court has received 27 cases regarding second marriage.
