Now, Tamil Nadu, Chhattisgarh to review SC/ST ruling for Dalit welfare

An official release said the Chief Minister has directed to file a review petition on behalf of the state against the Supreme Court order considering the welfare of Dalits and tribals.

The Tamil Nadu government on Tuesday announced that it would file a review petition against the March 20 judgment of the Supreme Court banning immediate arrest of persons accused of committing atrocities against Dalits.

A decision to this effect was taken during a review meeting chaired by Chief Minister Edappadi K Palaniswami at the secretariat. He was deliberating on the apex court order on the procedures to be followed for cases registered under the Schedule Caste and Schedule Tribes (Prevention of Atrocities) Act, 1989.

An official release said the Chief Minister has directed to file a review petition on behalf of the state against the Supreme Court order considering the welfare of Dalits and tribals. It said that the revision petition would be filed very soon.

The ruling AIADMK government's decision has come a day after the DMK-led opposition parties staged a demonstration seeking reversal of the SC order. DMK working president MK Stalin on Monday said that the Centre must file a review petition against the Supreme Court diluting the SC/ST Act or include that Act in the Constitution's Ninth Schedule and create a good ambiance. He also warned that if this was not done by the Centre, agitations would continue.

The Kerala government was the first state to file a review petition against the Apex court judgment diluting some of the provisions of the Act.

Chhattisgarh Chief Minister Raman Singh also stated on Tuesday that the state government will appeal against the decision of the Supreme Court on the SC/ST protection Act. The Chief Minister said the state government has always been sensitive towards the cause of SCs and Sts.

The SC ruling had led to an uproar among the SC/ST people who alleged that the Act has been diluted.
The Centre, on April 3, filed a review petition against the ruling, which went in vain as the top court refused to stay its order and asked all parties to submit detailed replies.
