Providing yet another window to regularise projects that have not taken prior green clearances, this time under Coastal Regulation Zone (CRZ) norms, the Ministry of Environment, Forest and Climate Change has decided to grant post-facto clearances after giving a window of three-months to receive applications.
The MoEF&CC has brought out a notification to this effect which stated that in light of representations from various stakeholders and a favourable decision by National Coastal Zone Management Authority (NCZMA), it has it has amended the CRZ notification, 2011.
The amendment also stated that CRZ clearances will now be valid for a period of seven years, instead of five years, provided that the construction commences within a period of five years.
Last June, the Ministry had provided a similar window of regularisation and post-facto clearances for real-estate and infrastructure projects that had violated green laws. The ministry had constituted a 11-member panel to adjudicate on project proposals that were received during a six-month, one time window.
In the new notification, the ministry's added a caveat that only those projects will be eligible where activities permissible under CRZ notification have been undertaken. The request to regularise projects has to be sent to the ministry by June 30. If the construction work for the project falls in the list of prohibited activities, it will continue to be treated as a case of violation.
"We had received representations from all coastal states and largely, the cases belong to the housing sector, but not of large-scale," a ministry official said.
