No undue relief given to Sanjay Dutt: Maha to HC

Advocate General Ashutosh Kumbhakoni on Monday filed an affidavit in the Bombay High Court indicating that no remission was granted to actor Sanjay Dutt while he was on parole and furlough leave during his stay in prison, while undergoing a five-year sentence in the 1993 serial bomb blasts case.

In a nine-page affidavit, the government stated that Dutt was given three days of remission per month for good behavior, discipline and participation in the various institutional activities such as physical training, education programmes, etc. He was given a further four days of remission per month for performing the allotted work in accordance with the prescribed standards.

The affidavit gives a detailed break-up of the time that Dutt served in prison after he surrendered on May 16, 2013. It says that Dutt earned a total of 256 days of remission, which comes to eight months and 16 days. It adds that Dutt had, on October 19, 2015, filed an application with the authorities seeking special remission, but the same was rejected.

The state filed the affidavit opposing a public interest litigation filed by activist Pradeep Bhalekar, through his advocate Nitin Satpute, who alleged that the government had granted extra remission to Dutt claiming good conduct.
