Nitish Katara case: Jail authorities pulled up for keeping Yadavs with undertrials

The Delhi High Court on Friday came down heavily on Tihar jail authority for keeping Vikas and Vishal Yadav, convicted in murder of Nitish Katara, in the jail meant for undertrials instead of convicts.

A division bench of Justice Gita Mittal and Justice VK Shali pulled up the jail authority, asking it to inform the court within two weeks about the "norms for under-trials" in the jail.

The bench also questioned how the Yadavs were not kept in the convicts' jail. "How come they were not kept in convicts' jail. Everyone should be treated uniformly. It is most inappropriate. The jail authority cannot flout rules..." it said.

"We want to know what is the procedure in jail for under-trials and convicts. If required, we will call the jail officials to explain the situation," said the court.

The court's observation came when Delhi Police counsel Dayan Krishnan told the court that Vishal and Vikas were kept in undertrials jail for few months after their conviction and had been shifted back to the same jail for the last six months.

The court was hearing a plea filed by Neelam Katara, mother of Nitish Katara alleging that jail officials have illegally allowed Yadavs to visit various hospitals under the pretext of health problems. The court posted the matter for March 15.

Vikas Yadav, son of Uttar Pradesh politician DP Yadav, was convicted in 2008 along with his cousin Vishal for kidnapping and murdering Nitish Katara, a close friend of his sister Bharti. Both are serving life terms in the Tihar jail.

The duo killed Katara, son of an Indian Administrative Service officer, on the night of February 17, 2002, after abducting him from a marriage party in Ghaziabad as they were opposed to his relationship with Bharti.
