NIA says will not oppose bail for Lt. Col Purohit

Purohit and the other accused Sudhakar Dhar Dwivedi, moved apex court saying that their detention without trial was illegal since the investigation has remained incomplete with NIA failing to file charge sheet.

The National Investigation Agency (NIA) on Monday submitted in the Supreme Court that it will not oppose bail for Malegaon 2008 blast accused Lieutenant Colonel Purohit. The NIA said it no longer wants custody of the terror accused since the chargesheet has already been filed. 

“Charge sheet has been filed in the case and argument on framing of charges is going on and at the moment the agency is not pressing for police custody of the accused,” NIA told a bench comprising of Justices RK Agarwal and AM Sapre. 

After recording the submissions, the bench adjourned the matter for further hearing.

Purohit and the other accused Sudhakar Dhar Dwivedi, moved apex court saying that their detention without trial was illegal since the investigation has remained incomplete with NIA failing to file charge sheet. The duo sought bail expeditious hearing of the case saying that they were suffering all these years due to NIA’s tardy pace of investigation. 

In an earlier hearing, the apex court had directed the special court in Maharashtra to expedite the hearing in the case. It also asked the special court to decide on the bail pleas filed by Purohit and Sadhvi Pragya Singh Thakur.

The court had said that apart from accused Rakesh D Dhawade, who is allegedly involved in similar cases in Parbhani and Jalna, MCOCA could not be invoked for the other accused persons.
