Need systematic responses to sexual violence: CJI H L Dattu

Expressing concern over the security of women, Chief Justice of India H L Dattu said security of women can be achieved by not curbing their freedom and liberty but through a systematic response to sexual violence.

"I would state that physical security of women is achieved by not curbing their freedom and liberty. We have to find systematic responses to sexual violence and we should not resort to the measures which will have adverse impact on them," Justice Dattu said while addressing the lawyers at a function on Law Day.

He said 65 years after the constitution was set up, the country has to fulfil some constitutional promises that includes meeting the needs of the poor.

Justice Dattu cited example of South African court which gives priority ensures protection socio-economic rights of the marginal section. "If we are unable to ensure basic necessities then we fail in discharging our constitutional duties."

"He emphasised on improvement in criminal justice system saying the police force works in conventional way, which needs to be improved. "India's criminal justice system needs reform on urgent basis in multiple fronts. In adequate police force, their significant training and technological upgradation and improvement working condition need to be improved," he said adding that a National Legal Aid mechanism will help the downtrodden who seek justice through the existing system.

Focussing that political freedom can not be achieved if we fail to ensure the basic necessities in this country that is food education, sanitation, health and employment for people of this country, the head of Indian judiciary said "Although to some extent they have achieved through legislative measures and judicial pronouncements still we have to strive hard to achieve completely.

With global economic growth and its influence on domestic fiscal policies, we have to take measures and safeguards for socio-economic security.

Courts and government have to jointly work to ensure the social economic rights of the people as the same is linked to many legal system. He cited example of South African courts which deal the cases on priority basis to guarantee socio-economic rights of the marginal section of the society.

The Union Law Minister Sadanand Gowda, who was also present at the function said that government is making all efforts to reduce the pendency of cases in court. He also reiterated that the NDA government's move to regulate litigations between the ministries and intra departments. He also said government's attempt to repeal obsolete laws to enable a friendly environment with the changing circumstances.
