National Conference fields retired J&K HC judge from Anantnag

National Conference has fielded a former J&K High Court judge -- who had ruled that Article 370 of the Constitution cannot be abrogated, repealed or even amended -- from Anantnag parliamentary constituency of troubled South Kashmir.

Justice Hasnain Masoodi had created a flutter in December 2015 when he ruled that the Article 370 enshrined in the Constitution of India cannot be abrogated, repealed or even amended and observed that replacing the post of 'Sadar-e-Riyasat' (president of state) by Governor (in 1965) was "not within the amending power of the state legislature".

Justice Masoodi had also directed hoisting of state flag on the "buildings housing offices of Constitutional Authorities and on the vehicles used by such authorities".

Days later a two-judge bench of Justice BL Bhat and Justice Tashi Rabstan stayed the order of the single judge bench of Justice Hasnain Masoodi.

The decision to field the retired high court judge was taken by parliamentary board of National Conference on Tuesday. On Monday the board had cleared names of Dr. Farooq Abdullah for Srinagar- constituency and Mohammad Akbar lone for Baramulla constituencies.

"It has been decided that Justice Hasnain Masoodi will be the party candidate from Anantnag parliamentary seat. Farooq Sahab and Mohammad Akbar Lone have already been nominated for Srinagar and Baramulla constituencies respectively", said Ali Mohammad Sagar, General Secretary of National Conference.

Holding Masters in Law from Harvard, Justice Masoodi retired from J&K high court in 2016. A constitutional expert who wrote regular columns on the special status, Justice Masoodi was currently the Chairman of Juvenile Justice Board, Jammu and Kashmir.

"To me it is not an ordinary election. We are already getting hints that constitution amendments have been forced in. Efforts are made to demolish our autonomy and special status. I think next five years are going to be very important from the point of view of each and every Kashmiri", Justice Masoodi told DNA.

On the challenges of contesting from restive Anantnag constituency of south Kashmir, he said down the line everyone would appreciate that they cannot downplay the institutions.

"We have to make our effective presence felt everywhere and articulate our view point. We have to synchronise our efforts. We should not allow forces inimical to Kashmir to fragment and divide us", he said.
