Prime Minister Narendra Modi will decide on all matters relating to Lokpal, CVC and anti- corruption legislation under newly-formed delegation of powers on works handled by the Ministry of Personnel, Public Grievances and Pensions. The Prime Minister, who is also the Cabinet Minister for the ministry, will have a final say in "major policy issues relating to Right to Information (RTI)" and "constitution of a new all India service".
The Ministry has come out with an "internal delegation of powers for final disposal of cases" dealt by it. A note carrying details of work and final authority for its disposal has been circulated by the Department of Personnel and Training, among the ministry officials. The matters relating to CBI including grant of permission for filing extradition proceedings, framing of recruitment rules for Group 'A' posts in the agency, deputation of its officers of the rank of DIG and above to other organisations will be disposed at the level of Minister of State, said the note.
The Prime Minister will be deciding on disciplinary cases against Indian Administrative Service (IAS) and Central Secretariat Service (CSS) officers, Grade I and above, and Group' A' officers in CBI. The appeals filed by these officers and cases relating to their sanction for prosecution will be disposed at the level of Prime Minister, it said. The delegation of powers has no mention of any other administrative work related to the CBI to be dealt by the Prime Minister. The Ministry of Personnel acts as a nodal authority for CBI to facilitate its administrative work.
"The delegation of powers for works relating to the ministry have been formulated to remove any confusion from the minds of staff processing them and to have clarity on the level of authority to decide on the matters. It will help in speedy disposal of the ministry's work," a senior government official said. The Prime Minister will also decide on appointment, resignation and removal of chairman or members of Union Public Service Commission (UPSC), policy matters or legislation relating to anti-corruption measures, Lokpal legislation and law for making Central Vigilance Commission (CVC) a statutory body, the note said.
Any amendment to rules under the RTI Act will be carried out after the Prime Minister's approval, it said adding that the Prime Minister will be the authority to decide on "draft as well as final note for Cabinet matters". The note mentions delegation of powers for the Appointments Committee of Cabinet (ACC) headed by the Prime Minister.
The appointment or extension of tenure of Indian Police Service (IPS) officers of the rank of Inspector General equivalent or above in the CBI has to be submitted to the ACC for approval, it says.
Re-employment or extension of services of any person who has attained the age of superannuation in any state-owned public corporation, company or enterprise where the pay of Rs 22,400 or more (including pension and pensionary equivalent of retirement benefits) proposed to be fixed or given to such person will require ACC approval, as per the note. It also gives detail of channels for submission of various works to be processed at the level of Cabinet Minister (Prime Minister), Minister of State, Secretary and Section Officer. The Ministry is entrusted with works relating to personnel, anti-corruption measures among others. The ministry acts as nodal authority for Lokpal, CBI, CVC and UPSC.
