Mumbai: Man wants cops to search for 'stolen' buffaloes, moves HC

A Palghar resident approached the Bombay High Court seeking direction to the police to lodge a First Information Report (FIR) and search for 12 of his missing buffaloes.

A Palghar resident who owns a dairy farm has approached the Bombay High Court seeking direction to the police to lodge a First Information Report (FIR) and search for 12 of his missing buffaloes which have allegedly been stolen by his ex-employee. A division bench of justice Naresh Patil and justice Prakash Naik have asked the police to record the statement of owner Asif Shaikh and act forthwith in accordance with law. The petition, filed by Shaikh through his advocate Ganesh Gole, states that former employee of his farm Habibur Rehman, who had been sacked some time ago, came with his associates on June 22 and took away 12 buffaloes in a tempo. Cash and other properties from the farm were also stolen.

Furthermore, it stated that out of a total of 63 buffaloes some ran away into the jungle as they were untied by those people. The accused and his associates had come with iron bars and other objects with which several buffaloes were attacked. The complainant rushed to Manor police and informed about the case, following which the police visited the farm and recorded statements of Shaikh's business partner and employees.

However, repeated requests from Shaikh to lodge an FIR and carry out a search for his buffaloes fell on deaf ears. He even wrote to the superintendent of police of Palghar but to no avail. Following this, he approached the high court. The prosecution informed the court that Shaikh was called by the police for recording his statement but he did not turn up.

Advocate Gole, however, opposed the argument of the prosecution and said that instead the investigating officer pressurised the petitioner for settling the matter. The plea stated that the police are bound to have registered an FIR under various sections of IPC and Prevention of Cruelty on Animals Act. Inaction on part of the police is a blatant example of dereliction of duty. The plea prayed for directions to register an FIR and initiate appropriate disciplinary action against the officers concerned.
