Moninder Singh Pandher and Surinder Koli get death in Nithari case

The CBI could file chargesheets only in 16 cases of rape, murder, abduction and criminal conspiracy.

A CBI court on Monday sentenced businessman Moninder Singh Pandher and his servant Surinder Koli to death for the murder and rape of a domestic help — one of the many victims of the 2005-06 Nithari serial killings. Special Judge Pawan Tiwari said that the convicts crossed all limits of cannibalism, a tendency not seen even in animals.

Pandher and Koli were arrested in 2006 after the body parts of 19 minors and young women were found around Pandher's house near Nithari village in Noida, sending shockwaves across the country.

The CBI could file chargesheets only in 16 cases of rape, murder, abduction and criminal conspiracy.

Koli has got the death sentence in each of the eight cases decided so far. The rest eight cases are at different stages of trial.

Monday's verdict is the second one involving both Pandher and Koli. The court had sentenced them to death in one of the cases in 2009.

Pandher came out of prison in 2014 after he moved the Allahabad High Court. The Ghaziabad court on Monday mentioned the brutalities inflicted on Pinki Sarkar and said that the concept of a civilised society is possible only when the culprits, who have become a danger for the society, are awarded the death sentence.

The court said "such culprits do not have the right to live in this beautiful and great country.

It added that such a punishment is necessary to send out a message in the society so that people think twice before committing such crimes.

Children and young women of nearby slums kept disappearing mysteriously from around Pandher's residence, but the police did not take the families' complaints seriously till there was a public outcry.

On October 5, 2006, when Pinki was returning home from work, Koli abducted her, raped her and later killed her. After the murder, he beheaded her and threw the head in the drain behind Pandher's house.

The judge observed that Pandher "has put the society and nation in a state of shock by being a party in this inhumane, beastly, cruel and heinous crime".

"Koli in a series and organised manner used to lure the victims in the house when alone and without any mercy raped them and threw their bodies into the drain after chopping them into pieces. In some cases he also cooked and ate the flesh. Pandher was a party in this crime. There are nil chances of improvement in the convicts," the court observed.

Pinki's mother Bandana Sarkar said that she would have a peaceful sleep the day the two are hanged. "It's been 11 years... we have been waiting for justice but it has not been served yet. If they move the High Court, we shall also fight against them. They are powerful people but we will also fight for justice," she said.

Pandher's counsel Devraj Singh said that his client was in Dehradun on the day of the crime. He said they will appeal against the decision in the High Court.

Pandher's son Karan said, "Saturday's judgment has come as a shocker as there was hardly any evidence against my father." Pandher and Koli had been convicted by the court on Saturday. The sentencing took place on Monday.
