MHA to hold inquiry into NDFB encounter

Rajnish Rai's report, raising questions on the joint operation that reflects how systems and processes have weakened over a period of time, resulting in commission of such unlawful acts

Under pressure from the civil society in Bodoland, the Centre has decided to hold an independent inquiry into CRPF Inspector General Rajnish Rai's report alleging that two terrorists of National Democratic Front-Songbjit faction (NDFB-S) were killed in a staged-managed encounter by the Army, Assam Police, SSB and his own Force.

"An inquiry will be initiated soon under a retired DG level officer to find out veracity in Rai's report. The decision to choose a retired DG has been taken keep the inquiry independent of any bias," said a senior Home ministry source.

Rai's report, raising questions on the joint operation that reflects how systems and processes have weakened over a period of time, resulting in commission of such unlawful acts, had asked to entrust the investigation to an external independent agency for impartial and thorough investigation of the encounter.

The situation report prepared by the forces involved had claimed that two NDFB-S militants Lucas Narzary and David Islary were killed in Siliguri in Chirang district of Assam on March 30 in a joint operation by the Army, Assam Police, CRPF and SSB.

However, a few days later on April 17, Rai sent his probe report into the incident to Assam Chief Secretary V K Piperseina, the then acting CRPF DG Sudeep Lakhtakia, GOC of 4 Corps and Chairperson of Operational Group, Lt. Gen A S Bedi, Assam DG Mukesh Sahay, SSB DG Archana Ramasundaram; and CRPF ADG (NE Zone) Mohd Javed Akhtar.

The discreetly prepared probe report, citing nine witnesses and nine documents, picked holes in the situation report and claimed that the two sleeping young men were picked up by a joint team of 156 Bn. of CRPF and State Police from D-Kalling village on March 29. They were later joined by personnel from Army and 210 CoBRA Bn and the young men were killed near Simlaguri at 4:30 a.m. on March 30.

Rai's report alleged that the FIR filed by Assam Police as well as the special situation report prepared by other special forces "present a fictitious account of the joint operation by the security forces to conceal pre-planned murders of two persons in custody and present it as some brave act of professional achievement."
