Madras HC scraps TN govt's 85% state quota in UG medical admissions

In a far-reaching verdict, Madras High Court on Friday scrapped the Tamil Nadu government order reserving 85 per cent of the state quota seats in the undergraduate medical courses to students who have studied under the state board. Later, Tamil Nadu government announced that it would appeal against the order in the High Court.

Justice K Ravichandra Baabu passed the order on the petition filed by C Darnish Kumar, a CBSE student challenging the government order providing reservation for the state board students.

Tamil Nadu government whose two bills seeking to exempt the state students from NEET was pending for President's consent, had issued a government order on June 22 reserving 85 per cent of the medical seats in the state quota for the state board students and rest of the seats for the other boards.

The petitioner argued that powers to regulate admission to medical courses lie exclusively with the Medical Council of India (MCI) as per the Indian Medical Council Act. As per the norms stipulated by the MCI, the admission to medical courses should be based on the marks obtained in NEET and merit list prepared on the basis of such marks and it does not distinguish between CBSE and State Boards.

Appearing for the Tamil Nadu government, the Advocate General submitted that in Tamil Nadu, as many as 88,431 students appeared for NEET, out of which only 4,675 are from CBSE. With the marks obtained in the NEET being the basis for admission, the state government in order to ensure fair and equal opportunity to candidates from different board provided such reservation for the seats under the state quota, he explained. However, the judge quashed the government order rejecting the government's argument.
