Madan Tamang murder case: Relief for Bimal Gurung after court says lawyers can represent GJM

A sessions court on Tuesday rejected an appeal made by the Central Bureau of Investigation (CBI) to issue arrest warrants against top Gorkha Janmukti Morcha (GJM) leaders, including GJM chief Bimal Gurung for failing to appear before court.

The CBI lawyer put forward an argument that a proper hearing was not possible in the Madan Tamang murder case, unless the 22 accused were physically present at the court. However, this argument was ruled out by the judge.

The court accepted the plea of the lawyers representing the GJM leaders and said that lawyers of the GJM leaders, against whom the CBI sought arrest warrants, could represent them at the court.

While the CBI lawyer prayed for the arrest of the 22 GJM leaders including Gurung, who were leading the Gorkhaland Movement at the hills demanding a separate Gorkhaland to be carved out of Darjeeling and Kalimpong districts, the GJM counsel put forward a plea for the protection of GJM activists who reside at Gorkha Bhavan in Salt Lake and were allegedly being harassed. The court directed Bidhannagar City Police to look into the matter and submit a report to the court.

The GJM leaders had been summoned in connection with the murder case of All India Gorkha League (AIGL) leader Madan Tamang who was a known for his anti-GJM views at the hills was killed in Darjeeling on May 21, 2010. Other than Gurung, CBI, which is investigating the matter, had sought arrest warrants against Gurung’s wife Asha Gurung, Roshan Giri, general secretary of GJM and Binay Tamang, GJM assistant general secretary.

On Monday, 26 of the 54 accused in the case were seen present at the court. Of them the prominent ones were former GJM MLA Harka Bahadur Chettri and ex-GJM leader Pradeep Pradhan. Four of the 54 have died and two have been absconding.
