Lost in translation: Woman withdraws rape case after not understanding FIR written in Marathi

The Bench interviewed the victim and after being satisfied, quashed the case.

The Bombay High Court on Wednesday quashed a FIR, chargesheet and proceedings in a case of rape, unnatural sex and cheating after the complainant herself filed a petition for quashing it. The woman said that the officer had not explained to her the contents of the FIR correctly as she didn't know the Marathi language.

The woman and the accused had a relationship for about a year, but when she realised that the boy was married, she had approached the police. A Division Bench of Justice VM Kanade and Justice Nutan Sardessai while accepting the arguments put up by Advocate Mahesh Vaswani on behalf of the 20-year-old petitioner, said that even the Supreme Court of India has recognised live-in relationships and even recognised rights for the children out of such relationships. 

It was argued that girl had registered a FIR dated 03/12/2015 at the Khar Police Station, and the boy was arrested and was behind bars for over three months. The police had also filed a chargesheet in the case on 03/03/2016. Then, between May and June this year, the complainant had written to the Mumbai Police Commissioner and Chief Minister saying that the allegations in the FIR were wrongly recorded in her statement and that the Khar Police should record her further statement and absolve the boy of the charges of rape and other charges.

However, the Khar Police had informed the complainant that they would not record her further statement to clarify her case and she must approach the court. 

The Bench interviewed the victim and after being satisfied, quashed the case.
