Kulbhushan Jadhav case: Highlights of Pakistan's argument at International Court of Justice

India and Pakistan crossed swords at the ICJ over Jadhav's case with New Delhi demanding the immediate suspension of his death sentence and Islamabad accusing it of using the world body as a stage for "political theatre" through a "misconceived" plea.

India and Pakistan crossed swords at the International Court of Justice (ICJ) over Kulbhushan Jadhav's case with New Delhi demanding the immediate suspension of his death sentence and Islamabad accusing it of using the world body as a stage for "political theatre" through a "misconceived" plea.

The two neighbours -- who last faced off at the ICJ 18 years ago when Islamabad sought its intervention over the shooting down of its naval aircraft -- India took the Jadhav case to the world court, accusing Pakistan of violating the Vienna Convention and conducting a "farcical trial" for convicting Jadhav without a "shred of evidence".

On India invoking the Vienna Convention, Pakistan said, "The Vienna convention article 36 which adopted to set up standards of conduct particularly concerning communications and contact with nationals of the sending state which would contribute to the development of the friendly relations among nations...the observation we made immediately is this is unlikely to apply in the context of a spy, terrorist send by a state to engage in acts of terror."

Here are 10 arguments Pakistan made at the ICJ: 

1) Vienna Convention provisions on consular access were not intended for a "spy" involved in terror activities.

2) India's application on Jadhav must be dismissed on three counts - there is no agency, relief sought is manifestly unavailable and the jurisdiction is limited.

3) India's application on Kulbhushan Jadhav is unnecessary and misconceived.

4) India hasn't been able to prove that Jadhav is an Indian national or he is not a terrorist.

5) India has not been able to give an explanation for Jadhav's passport which bears a Muslim name.

6) Jadhav was given a fair trial and nothing can be further from truth.

7) India's allegation that Jadhav was kidnapped from Iran is far-fetched.

8) India was using the court as the "scene of political theatre" but "we will not respond in kind".

9) There has been deafening silence and no response from India on Pakistan's accusations on Jadhav.

10) ICJ is not a criminal court of appeal nor does it exercise criminal jurisdiction.
