ICJ stays Kulbhushan Jadhav's hanging: A timeline of his battle for justice

In a major diplomatic win for India, the International Court of Justice (ICJ) On Thursday stayed a death sentence given to Kulbhushan Jadhav until the court given its final decision.

India had approached the world court demanding immediate suspension of the death sentence given to its former Navy officer by a Pakistan military court.

"Pakistan should not execute Jadhav pending final proceedings. The decision to stay Kulbhushan Jadhav's execution pending ICJ hearing is unanimous," said Judge Ronny Abraham, President of the Court.

Stating that the circumstances of Kulbhushan Jadhav's arrest remains disputed, the court said , "India should have been granted consular access as per Vienna convention."

The court also said that Pakistan must take all measures at its disposal to make sure that Jadhav is not executed until final decision, and shall inform the court for all measures taken.
 

Meanwhile the specific relief sought by Indian at ICJ are

...On behalf of the republic of India, I request that pending final judgement in this case, the court indicate:

1. that the Govt of the Islamic Republic of Pakistan take all the measures necessary to ensure that Mr Kulbhusan Sudhir Jadhav is not executed.

2. That the Govt. of the Islamic Republic of Pakistan report to the court the action it has taken in pursuance of sub-paragraph (a); and

3.That the Govt of the Islamic Republic of Pakistan that no action is taken that might prejudice the right of the Republic of India of Kulbhushan Sudhir Jadhav with respect to any decision the court may render on the merits of the case.

"Indian stand is victorious, congratulate all concerned persons, especially the External Affairs Ministry, " said India's Attorney General Mukul Rohatgi.

"Hope that final decision also comes India's way and we can see Mr.Jadhav come back home," he added.

 The Jadhav case was taken to the world court on May 8 by India, which accused Pakistan of violating the Vienna Convention and conducting a "farcical trial" for convicting Jadhav without a "shred of evidence".

On its part, Pakistan told the ICJ that Vienna Convention provisions on consular access were not intended for a "spy" involved in terror activities and charged India with using the world body as a stage for "political theatre" in the Jadhav case.

The two neighbours last had a face-off at the ICJ 18 years ago when Islamabad sought its intervention over the shooting down of its naval aircraft.

Here's a timeline of Jadhav's case: 

March 3, 2016: Kulbhushan Jadhav, a former naval officer arrested.


March 24, 2016: Pakistan security forces claim Jadhav, "an Indian spy" arrested from southern Balochistan.

March 26, 2016: The Indian government claims there is no proof that Jadhav, a retired navy officer, who owns a cargo business in Iran, was arrested in Balochistan as claimed by Pakistan.

March 29, 2016: New Delhi seeks from Islamabad consular access to Jadhav. Over the next one year, it made 16 such requests which were denied by Pakistan.

April 12, 2016: According to a media report, Jadhav was charged with terrorism and sabotage in an FIR filed against him by the provincial Balochistan government.

April 15, 2016: Pakistan briefs envoys of the Arab and ASEAN countries here over Indo-Pak ties and the arrest of an alleged Indian 'spy'. It had earlier made a similar briefing to envoys of P5 (the US, the UK, Russia, China and France).

April 10, 2017: A Pakistani army court sentences Jadhav to death for "for his involvement in espionage and sabotage activities against Pakistan". India warns Islamabad that it is a case of "premeditated murder".

April 11, 2017: External Affairs Minister (EAM) Sushma Swaraj makes a statement in both the Houses of Parliament, asserting that India will go "out of way" to ensure justice to Jadhav who is an "innocent kidnapped Indian".

April 14, 2017: India demands from Pakistan a certified copy of the charge-sheet as well as the judgement in the death sentence of its national Kulbhushan Jadhav and seeks consular access to him.

April 20, 2017: India officially seeks from Pakistan details of the trial proceedings against Kulbhushan Jadhav as well as the appeal process in the case.

April 27, 2017: EAM Swaraj writes to Pakistan Foreign Affairs Adviser Sartaj Aziz requesting visa for Jadhav's family.

May 8, 2017: India approaches the International Court of Justice at Hague against Pak military court's decision.

May 9, 2017: ICJ stays Jadhav's execution.

May 15, 2017: India and Pakistan cross swords at the ICJ over Jadhav's case with New Delhi demanding the immediate suspension of his death sentence and Islamabad accusing it of using the world body as a stage for "political theatre" through a "misconceived" plea.

May 18, 2017: ICJ tells Pakistan to put his execution on hold pending its final order. Noted lawyer Harish Salve represents India
