SC judges against CJI: Issues unresolved, but Judges to resume work today

Three days after they left their courtrooms after a tiff with Chief Justice of India (CJI) Dipak Misra, and held a joint press conference, in which they highlighted the manner in which the CJI was breaching institutional integrity tinkering with well-settled systems, the four senior-most Judges of the Supreme Court will hold court on Monday.

They will also participate in meetings of the collegium "if the CJI calls" them.

"We have said whatever we had to say. It was not for any of our personal profit. The citizens are watching. What purpose will our remaining away from court achieve? We aren't on strike. The ball is in the CJI's court and he has to take a call," said one of the four Judges.

An indication about the mood of the four Judges had come on Saturday itself with Justice Gogoi saying "there is no crisis" while Justice Joseph had said that there was no need for an outside intervention to solve the issue.

Sources in the Supreme Court said the CJI is likely to call a meeting of the Full Court soon to discuss the issues raised by the four judges.

In a day of swift-moving developments, it became increasingly clear that the CJI Misra doesn't have much support among his brother-Judges, with several judges supporting the issues raised by the four senior judges. There was near-unanimity that the Judges had "scored a moral victory".

Incidentally, while Justice DY Chandrachud met Justice Chelameswar last evening for over an hour, Justice Sharad Arvind Bobde, who will be CJI after Justice Gogoi, also visited him again on Sunday. On Friday also, Justice Bobde and Justice L Nageswara Rao had met Justice Chelameswar.

At least three other Judges of the Supreme Court confirmed to DNA that they had spoken to at least one of the four Judges since Friday.

Another senior judge, one of the four, told DNA that "several Supreme Court Judges" had called him or visited him to "discuss the issues". "Many of them agreed with the need for the existing system to be reformed. But, lest you see a conspiracy in this, let me clarify, there is no union being formed. We are all friends and colleagues," he said.

Meanwhile, a seven-member delegation of the Bar Council of India (BCI), the regulatory body of lawyers, met Justice Chelameswar at his residence to discuss the crisis that has hit the judiciary. The delegation also met some other judges.
