The Sheena Bora murder whodunit took another twist on Tuesday, with accused Indrani Mukerjea seeking a divorce from husband and co-accused Peter, alleging that he had framed her in the case.

The bombshell came shortly after the special Central Bureau of Investigation (CBI) court permitted framing of murder, conspiracy and destruction-of-evidence charges against Indrani, her former husband Sanjeev Khanna and Peter .

Claiming that she was feeling very isolated and that her former media mogul husband was falsely implicating her in the murder, Indrani requested a divorce from Peter; the court, presided over by judge HS Mahajan instead directed her to approach a family court as it was her personal decision to do so.

Indrani said that since she is in judicial custody, she wanted to get confirmation from the sessions court on whether she could approach the family court for her proposed divorce.

Indrani also said that since she has decided to donate 75 per cent of her property to NGOs, she wished to make changes to her will too. “The only reason I am approaching the court is to ensure that there is no contempt of court,” she said.

As for the criminal charges against the trio, the gave detailed reasoning for allowing the charges to move forward. A copy of the court’s order, which DNA accessed, reads: “I have carefully gone through the statements of all the witnesses, the prime witness being the security guard of Marlow building, Rahul Mukerjea (Peter’s son), Kajal Sharma (Indrani’s secretary) and approver Shyamwar Rai (Indrani’s driver). The email record, SMS record and call details are also considered by the court for framing of the charge.”

The court rejected five other counts on which the CBI had sought to charge the accused.

After the charges were framed, Peter addressed the court and said he would like to speak during the next hearing. The court said he would get his chance after the evidence in the case was examined, and that there would be a fair trial. “You can also cross examine witnesses. Whatever rights you have will be protected,” the judge said.

The matter has been adjourned to February 1, when the prosecution is likely to produce the list of witnesses it will examine.

According to the CBI, Indrani, along with Khanna and her driver Shyamwar Rai, allegedly plotted the murder of Sheena Bora and later disposed of her body. Later, a CBI investigation added Peter Mukherjea’s name to the list of those suspected of being involved in the murder.

The court has rejected these five charges against the accused:

202 intentional omission to give information of offence by person bound to inform
328 causing grievous hurt using poison
384 extorted
420 cheating
468 forgery for cheating
(All the sections are under the Indian Penal code)
