I was there with them when no one was: Deepika Singh Rajawat after being removed as Kathua rape victim's lawyer

Deepika Singh Rajawat, the Jammu-based lawyer who hit headlines as the advocate standing up for the Kathua rape and murder victim, earning praise from around the globe, has been removed from the job by the victim’s father.

The complainant’s father moved an application in court seeking Rajawat’s removal and the court agreed.  Rajawat had moved Supreme Court to get the case shifted from Kathua to Pathankot.

In his application, counsel Mubeen Farooqi, representing the victim’s father, claimed that since the two Special Public Prosecutors were doing an ‘effective jobs’ they seek the removal of power of attorney of Deepika Singh Rajawat.

Reacting, Deepika Singh Rajawat wrote on Twitter: “I was there with them when no one was. Now since the rainy days have passed, they are winding up with me just because I could not regularly attend the trial which is taken care of by senior criminal lawyers. I don't blame them. it is the human tendency which travels in genes.”

She also put up a Facebook video explaining her position.

 

She had only appeared twice in Pathankot court since the case was shifted there.

Farooqi, the victim's father's counsel had said: “The case is being heard on a day-to-day basis, but Deepika thought it prudent to appear just three or four times in the last six months. That is why we have moved an application seeking her withdrawal.”

Commenting Rajawat said: “The case is in safe hands with two senior advocates handling the prosecution side. The crime branch officers of the J&K Police too are doing a competent job.”

Rajawat also told Tribune: “I never charged [a] single rupee from the complainant and all I wanted was justice be served to the victim. I am currently overworked and have several cases in both lower courts and Jammu and Kashmir High Court.”

She also said she had no grudge against anyone and she would stand by the family.

Earlier, Talib Hussain, an activist who fought for the victim was accused of sexual harassment and rape by a JNU student. He is currently lodged in jail after being accused of rape by his sister-in-law. He had alleged that he was being tortured in police custody.

Senior advocate Indira Jaising had refused to appear for the family of the social activist, upon learning that the man whom she was defending had been accused of rape by a student from Jawaharlal Nehru University (JNU) in the #MeToo movement. Talib Hussain, the activist in question, had championed the cause of the Kathua rape victim, and had successfully shifted the trial in the case out of the state of Jammu and Kashmir.
