Almost two weeks after the Hussaini building collapse in Bhendi Bazaar on August 31, that killed 33 persons and injured 17, the JJ Marg police on Wednesday registered a First Information Report (FIR) against officials of the Saifee Burhani Upliftment Trust (SBUT), which is carrying out the Bhendi Bazaar redevelopment project, and other accused.

According to a statement issued by the police on Thursday, between March 28, 2011 and August 31, 2017, SBUT officials were aware that Hussaini building was dangerous to live in and Maharashtra Housing and Area Development Authority (MHADA) had granted permission to demolish it. The statement added that despite officials knowing the consequences if the building collapsed, it was not vacated.

The case has, therefore, says the statement, been registered on the complaint made by Police Sub-Inspector Anand Deshmukh against SBUT officials and others under Section 304 (2) (culpable homicide not amount to murder), 337 (causing grievous hurt) and 338 (causing hurt by act endangering life of others) of the Indian Penal Code.

"We have registered an FIR after conducting a preliminary inquiry wherein we have found that the SBUT did not take strict action to vacate the building. We are ascertaining which officials from SBUT are responsible for the tragedy," said Jaideep Gaikwad, Senior Police Inspector of JJ Marg Police Station. He added that that the police will record statements of all the residents of the building and other residents of the area.

When contacted, an SBUT spokesperson said, "So far, we are not aware about any case registered against the trust and its officials."
