In a significant observation, the Delhi High Court has said that the upgradation of Deen Dayal Upadhyay Hospital (DDUH) near Tihar Jail is required to stop the jail inmates from going to various other hospitals for treatment.

"Upgradation of DDUH is required to stop the inmates from going to various other hospitals for treatment," said a bench of justices Gita Mittal and V K Shali, while examining an Army medical board report on repeated visits of the Nitish Katara murder case convicts Vikas and Vishal Yadav to various hospitals from Tihar jail.

"It is in the public interest that facilities are made available to the undertrials and convicts lodged in Tihar. We direct Medical Superintendent to submit a report about the infrastructure, facilities available for the inmates," the bench said.

As per an earlier court order, a medical board of the Army's Research and Referral (R&R) Hospital submitted its report recently on the frequent hospital visits of the two murder case convicts, serving life terms in Tihar Jail.

While going through the report in open court, the bench also observed that many of the duo's visits were unjustified.

The bench opened the report in courtroom yesterday and referring to its contents said, "The report is very categorical. Some visits to the hospitals by accused (Vikas and Vishal) are justified but more visits and also admissions are unjustified."

The bench, also directed the high court registry to supply the copy of the report to the parties, directed the accused as well as the complainant to respond to its contents within three weeks. (More)

The court had earlier asked the medical superintendent of the Army's Research and Referral (R and R) Hospital to form a board of doctors and evaluate the medical records of both the convicts and give a report "as to how many of their visits from Tihar to AIIMS and Batra hospitals were justified."

The bench had given the order on a plea of Neelam Katara, the victim's mother, who had alleged that Vishal had made 87 visits to Batra Hospital and Vikas was shifted from 'B' class facility to 'A' class at AIIMS after their conviction in 2008.

During the course of hearing yesterday, the city police informed the court that two policemen were dismissed from their services for allowing Vikas to go out of AIIMS during his admission in custody on 'Diwali' night last year.

Filing an affidavit before the bench, Delhi Police counsel Dayan Krishnan said "a head constable and a constable have been dismissed from service last month for their failure to perform their duty."

The lawyer said after an enquiry, it was found that these policemen had colluded with Vikas and allowed him to move out of his room in AIIMS on the night of October 26, 2011 which was the day of Diwali.

The bench asked the counsel to place the affidavit on record and posted the matter for October 5.

Earlier, the court had asked police to take action against the erring officials following the AIIMS report which had stated that Vikas had moved out without informing the nurse, who was on duty that night. (More) PTI PNM RAX 08181850 NNNN

Victim's mother Neelam Katara had sought enquiry into the absence of Vikas from the hospital. She had also sought enquiry into Vishal's visits to Batra hospital.

In 2008, a trial court had awarded life imprisonment to Vikas, son of former Rajya Sabha MP D P Yadav, his cousin Vishal and also similar punishment to third accused Sukhdev Pehalwan who had been tried separately as he had absconded during the trial of Yadavs in the case.

Nitish Katara, a business executive, was abducted from a marriage party at Ghaziabad on the intervening night of February 16-17, 2002 and was later killed for his alleged intimacy with Vikas' sister Bharti.
