Home ministry referred 24 cases to CBI, ten to state police concerning FCRA violations

The Union home ministry has referred 24 cases to the Central Bureau of Investigation and ten cases to state police departments for violations of various provisions of Foreign Contribution Regulation Act by the NGOs.

Out of the four NGOs against whom Union home ministry has received complaints for FCRA violations two are — Tuticorin Diocese Association and Centre for Promotion of Social Concern both based in Tamil Nadu, were already being probed by the CBI and state police respectively.

Minister of state for home affairs Kiren Rijiju provided the information while answering the question raised during the ongoing session of the parliament.

Rijiju informed that the NGOs against whom inputs for violation of FCRA regulations were received during the last three years include Tuticorin Diocesan Association, Tuticorin, East Coast Research and Development Trust, Thoothukudi, Centre for Promotion and Social Concern, Madurai and Greenpeace India, Chennai.

As per the details provided by the minister, case of FCRA violation by TDA was referred to CBI in February 2012, which later referred it back to the home ministry. In 2012 only, the home ministry conducted inspection of accounts of TDA and suspended its FCRA registration for 180 days in September 2012. The case of Centre for Promotion of Social Concern was referred to ADG police in Tamil Nadu in July 2012.

However, as of now all four organizations, against whom government has received complaints are registered with home ministry in its FCRA division.

Out of the 24 cases, the CBI has filed chargesheet in 10 cases, a closure report is to be filed in one case, three cases have been referred back to home ministry while other cases are being investigated.

Rijiju also informed that the foreign contribution under FCRA in 2012 -13 was around Rs11,000 crore, while in 2013-July 2014, the NGOs have already received more than Rs476 crore. Both in 2012-13 and 2013-14 United States, Germany and United Kingdom remain the biggest donors. Among the states NGOs operating from Delhi, Tamil Nadu, Andhra Pradesh and West Bengal remain the biggest recipients of foreign fundings.

The minister informed the parliament that after carrying out inspection of records, if material evidence of serious violation of the provisions of FCRA is found against any association, the case is referred to CBI or state police for further investigation and prosecution. "Besides the association is also prohibited from receiving foreign contribution, freezing of its bank accounts and canceling registration," Rijiju said.
