The Bombay High Court today granted two-week time to Maharashtra government for filing its reply to a PIL seeking a CBI probe into the alleged suicide of a 27-year-old MNC executive whose body was found on the railway tracks in suburban Mulund in 2010.

While police alleged that the victim committed suicide after escaping from their custody, the PIL said the probe should go into the circumstances in which he died.

The court had, before Diwali vacations, asked the government to respond to the PIL.

When the matter came up for hearing today, prosecutor Sangita Shinde, on behalf of the Principal Home Secretary of the state, sought time for another two weeks, which was granted by a bench of Justices P V Hardas and Girish Kulkarni.

Kapil Patil, the deceased, was employed with an MNC.

According to Ketan Tirodkar, a journalist-turned-petitioner, a senior police officer had allegedly tried to frame Patil in a false case.

Patil, who helped underprivileged children with education, had learnt about a senior police inspector of Navghar police station in Mulund having an affair with a young girl. He persuaded the girl to complete her education and career, following which she stopped seeing the officer.

Afterwards, Patil was picked up by police and charged in a false case before he secured bail, Tirodkar said.

According to the PIL, Patil was picked up again and his body was subsequently found on the tracks on March 21, 2010.

Patil had no criminal antecedents and hailed from a well-educated family, with his father being a bank employee, the petitioner said.

Police station diary had a noting as "escape from custody" about his disappearance but no wireless message was ever sent to other stations in the meantime, said the PIL.

The state government had ordered a CID inquiry but it did not yield any result, the PIL said and prayed for a CBI probe.
