The Allahabad High Court today ruled that the Deputy Secretary of Uttar Pradesh Higher Education Services Commission, Sanjay Kumar Singh, had "no right to occupy the post" and directed him to "forthwith vacate such office".

Passing the order, a Division Bench comprising Justice Arun Tandon and Justice Ashwini Kumar Mishra remarked, "We are sad to notice the state of affairs in which a person facing serious charges of manipulating his appointment on the strength of forged documents is rewarded by being made Secretary of an important Commission".

Sinha has been holding the additional charge of Secretary of the Commission since 2012 in view of the post being vacant.

The court made the above observations in the light of the allegations that Singh had submitted "forged" documents to secure appointment as an ad hoc lecturer in a degree college - way back in the 1990s - which made him eligible for the key post in the Commission.

Allowing the petition of Dhirendra Singh and another, both associate professors in post graduate colleges affiliated to the Deen Dayal Upadhyay University at Gorakhpur, who had challenged Singh's appointment "as ad hoc lecturer in a government degree college as well as his subsequent placement on deputation as Deputy Secretary of UP Higher Education Services Commission".

The petitioners had alleged that Singh had secured appointment as an ad hoc lecturer upon submitting a "fake" marks sheet and also, having applied in the Scheduled Tribes category, "misrepresented" himself as belonging to the ST category.
