Haryana: Wife gives triple talaq to husband on paper before eloping with lover

Amid the controversy over triple talaq, a woman in Haryana's Yamunanagar turned the tables on her husband, using the contentious practice to "divorce" him.

Shazia, a mother of three, "divorced" her husband, Abbas, by writing "talaq talaq talaq" on a piece of paper, police said on Friday.

The woman, a resident of Unhedi village, then eloped with her lover, who also happens to be her nephew, they said.

Shazia, in a letter to her husband, said, "I am divorcing you out of my own free will. I am leaving this house because you tortured me ever since we got married. You would beat me after getting drunk. Hence, I am taking talaq." 

She added that she was not doing it under anybody's influence.
"Nobody else is responsible," Shazia wrote.

Police said she eloped with her nephew, who is a bachelor. 

The practice of instant talaq is used by some Muslim men to divorce women.
In a landmark verdict, the Supreme Court last year had ruled that the practice of divorce through triple talaq among Muslims as "void", "illegal" and "unconstitutional".

The government later brought a bill that criminalises instant triple talaq, which was passed by the Lok Sabha. But an amended version of the bill is yet to taken up by the Rajya Sabha.

The three amendments suggested by the cabinet includes, a crime of triple talaq will be cognizable only if the victim or her blood relatives or someone associated with the marriage files the complaint; the crime remains non-bailable, but a magistrate can grant bail after hearing the victim; the third amendment makes the crime compoundable.

The Prime Minister earlier hit out at those opposing the end of the ‘Triple Talaq’ practice and said,”I assure Muslim sisters and daughters that their rights will be protected and the government will not leave any effort to protect them. I promise and assure that I shall fulfill your aspirations.” In a veiled attack on the Congress and other opposition parties, Prime Minister Narendra Modi said there were some people who did not allow the passage of the Triple Talaq Bill in Parliament during the just-concluded monsoon session. 

He said that his government tried to bring the Bill in Parliament in the just concluded monsoon session after the Cabinet had approved some amendments to end the practice of Triple Talaq. "But there are some people who do not want it to be passed," the Prime Minister said in an apparent jibe at the Congress and other opposition parties, after the Bill was deferred on the session's last day in Rajya Sabha due to lack of consensus.
