Raising another controversy, suspended IPS officer Sanjiv Bhatt on Tuesday filed an affidavit in Gujarat High Court, alleging that he had been facing the consequences as he did not bow down before Chief Minister Narendra Modi and former Home Minister Amit Shah in 2003 in the Haren Pandya murder case.

Bhatt, on oath, has stated that in November 2003, when he was posted as superintendent of Sabarmati jail, he had come across very important documentary evidence regarding the role of highly placed state functionaries, politicians and senior police officers in the killing of Pandya. He had then forwarded the said documentary evidence, along with a report, to the home department.

However, on the same day, he received a call from Shah, expressing his displeasure and asking him to destroy the report and evidence immediately. Followed by the conversation, Bhatt forwarded another report putting on record the telephone conversation and sent it to Shah as well as Modi, the petition states.

“As Bhatt refused to comply with the illegal verbal directions, he was consequently transferred by the chief minister and was kept without any posting,” alleged the affidavit.

Connecting the issue with the encounter cases, Bhatt has stated that in November 2005 he had come across the staged police encounter of Sohrabuddin and in December 2006 he learnt about the killing of Prajapati in a similarly enacted encounter.

Hinting at the nexus between the murder of Pandya and the encounters of Sohrabuddin and Prajapati, Bhatt has said in his affidavit: “The arrest of Abhay Chudasama and Amit Shah in 2010 by the CBI in connection with the killing of Sohrabuddin and his wife fortified the suspicion in his mind about the real motives behind the efforts undertaken by Modi and Shah to persuade him for withdrawal and destruction of the reports.”

However, Bhatt restrained himself from disclosing any further facts. “He is under legal advice not to divulge further details about the said matter except before an appropriate statutory body or agency legally empowered to investigate into real conspiracy and motive behind the killing of Pandya,” reads his petition.
