Gujarat High Court reserves judgment in Alpesh Kathiriya bail plea

The Gujarat High Court on Tuesday reserved its judgment in the bail plea filed by Patidar Anamat Andolan Samiti's (PAAS) convenor Alpesh Kathiriya, who is behind bars on charges of sedition after widespread violence erupted during Hardik Patel's quota stir. The single judge bench of justice AY Kogje declared that the judgment will be pronounced on November 19.

Notably, both the state government as well as counsel for Kathiriya on Tuesday concluded their arguments. While public prosecutor Mitesh Amin vehemently opposed the bail plea citing the gravity of charges including trying to wage a war against the state government, the counsel for Kathiriya contended that he needs to be provided bail as the other accused are already out and his legal practice is getting affected.

Kathiriya's lawyer also contended before the court that the charge of the state government that the accused was absconding for two years to avoid arrest was baseless. It was contended that Kathiriya had filed several 'vakalatnamas' during the past two years as a practicing lawyer and there was no attempt on part of the state to arrest him. Also, it was submitted that there was no warrant against the accused.

Meanwhile, the state government also submitted an affidavit opposing the bail plea of Kathiriya. In the affidavit, it has been pointed that Kathiriya played a key role during Hardik Patel's quota stir that resulted in widespread violence across the state. The state has cited the information obtained through the call data records of Kathiriya which allegedly indicate the same.
