False complaint by daughter: Man freed of molestation charge by Delhi court

A man has been acquitted of the charge of molesting and sexually assaulting his daughter by a Delhi court after the girl stated that she had lodged a false complaint due to his habit of picking quarrels with her mother.

Additional Sessions Judge Rajneesh Kumar Gupta absolved the man, a resident of Patel Nagar here, of the charges of molesting and sexually assaulting his 10-year-old daughter under section 354 of the IPC and section 8 of Protection of Children from Sexual Offences (POCSO) Act, respectively.

"The girl and her mother are the material witnesses of the case but they have not supported the case of the prosecution.

"They have been cross­examined but no such material has been come on record which would support the case.

Accordingly, he is acquitted," the judge said.

The court noted that in her deposition in court, the girl said that her father used to quarrel with her mother after consuming liquor and she used to remain disturbed for this reason, so she made a false complaint against him.

It also noted that the mother of the girl, who had initially supported her in the complaint, told the court that after the father had spent two months in jail, she came to know that her daughter had lied about the incident.

According to the prosecution, on January 21 this year, the girl had lodged a complaint alleging that her father, under the influence of alcohol, sexually assaulted her when her mother was away at work.

Later, the girl narrated the incident to her mother, who beat the man up and took the girl to the police station to lodge a complaint against him.
