Pune sessions court granted bail to the three accused in the Dr Narendra Dabholkar murder case as Central Bureau of Investigation (CBI) lawyers failed to remain present at the bail hearing.
Three accused Amit Degvekar, Amol Kale and Rajesh Bangera were granted bail by the judicial magistrate (first class) SMA Sayyad on Friday. All three were arrested in journalist Gauri Lankesh's murder case by the special investigating team (SIT) of Karnataka. Later, CBI arrested the trio in Dabholkar murder case. After their arrest, first Bangera and Degvekar have remanded CBI custody on September 1 while Kale was remanded to CBI custody on September 12.
Defence lawyer Dharmaraj Tandel moved an application for the bail of these three accused claiming that the stipulated time period of 90 days to file the chargesheet has lapsed. "Since the CBI failed to file the charge sheet against these three persons, we moved the application and today the court granted bail to all the three," Tandel said.
Apart from these three, CBI had also arrested other two accused Sachin Andure and Sharad Kalaskar in the same case. The investigating agency had sought the extension to file the charge sheet against Andure and Kalaskar after it invoked Unlawful Activities (Prevention) Act in the case and got the extension of 45 days.
"The extension was only for filing charge sheet against Andure and Kalaskar. There was no extension for these three accused hence, they were entitled to the bail," Tandel said.
No CBI lawyer was present when on the bail hearing in the Pune court. "The CBI lawyer had approached the court on Thursday seeking adjournment over the bail application. The judge had kept the matter for hearing at 4 pm but the lawyer did not turn up for the hearing," Tandel said.
