Two days after dna reported that three accused in the February 2012 Park Street gang rape case – Nasir Khan, Ruman Khan and Sumit Bajaj were posting Facebook updates straight from their prison cells in West Bengal, jail authorities seized a phone from the possession of Ruman Khan.

“We have seized an android phone from the possession of Ruman Khan. The smartphone was run on a 3G-enabled SIM card. We will be filing an FIR against him,” said Adhir Sharma, ADG, West Bengal Correctional Home Services.

According to sources, the jail department is likely to initiate an enquiry into the use of a mobile phone by Ruman Khan and examine his call details.

While officials of the Correctional Home seized a phone from the possession of Ruman, currently lodged in Presidency jail, they did not find any phones on Nasir Khan and Sumit Bajaj, lodged in Dum Dum jail.

Prison authorities also highlighted that since mobile phones and SIM cards fail to find a mention in the list of prohibited articles inside prisons, the officials fall short of slapping charges of violation against the inmates.

“The West Bengal Correctional Home Services have written to the home secretary of the state thrice, demanding an amendment to the Act of Prohibited Articles. But, the state administration has turned a blind eye,” said a senior official of West Bengal Correctional Home Services.

Meanwhile, all three undertrials have deactivated their Facebook profiles after dna highlighted how these net-savvy criminals were active on social media from their prison cell and uploading pictures clicked inside their cells.

The Park Street rape survivor, Suzette Jordan, died of meningoencephalitis in a hospital in Kolkata on 13 March this year. In the early hours of February 6, 2012, she was raped at gunpoint in a moving car by five men. While Indian laws forbid the disclosure of a rape victim's identity, Jordan had chosen not to hide her name and had come out strongly against her aggressors. However, more than three years later, her rapists are still to be convicted and sentenced.
