Disproportionate Assets: High Court refuses to quash case against Himachal Pradesh CM Virbhadra Singh

In more trouble for Himachal Pradesh Chief Minister Virbhadra Singh, the Delhi High Court on Friday dismissed a plea by him and his wife which sought the quashing of an FIR by the Central Bureau of Investigation (CBI) in a disproportionate assets case.

While dismissing the plea, Justice Vipin Sanghi also vacated an order passed by the Himachal Pradesh High Court’s interim order which restrained the CBI from arresting, interrogating and filing a chargesheet in the case without prior permission from the court.

Speaking to DNA, the counsel for Virbhadra Singh and Pratibha Singh said that they are going to appeal against the judgment.

CBI had registered an FIR against the CM for allegedly amassing property of Rs 6 crore between 2009-12, during his tenure as the Union Steel Minister. In his plea, however, the CM had contended that raids were conducted in his private residence and other places with “malafide intentions and political vendetta” by the investigating agency.

The plea also mentioned that there was no order or direction by which any court had allowed the CBI to enquire, investigate or register regular cases and exercise jurisdiction in the state of Himachal Pradesh.

The CBI argued that the allegations against the CM are “very serious” and the state government had shown “over anxiety” in protecting him. They also stated that it had the power to register the case in the national capital because the said embezzlement was made during Singh’s tenure as a Union Minister in United Progressive Alliance (UPA)- I.

The matter was transferred by the apex court to the Delhi HC which had asked Singh to join the probe.

Singh had asked the court to quash the FIR registered under Sections 13(2) and 13(1)(e) of the Prevention of Corruption Act and Section 109 of IPC by CBI on September 23, 2015.
