Delhi: State Tobacco Control Dept sends show-cause notice to leading nicotine-promoting brands

Delhi State Tobacco Control Department has sent a show-cause notice to two leading Nicotine products brands for a surrogate advertisement of tobaccos in a leading newspaper.

Delhi State Tobacco Control Department has sent a show-cause notice to two leading Nicotine products brands for a surrogate advertisement of tobaccos in a leading newspaper.

The nicotine-promoting companies has been instructed to immediately withdraw the advertisement and not promote such ads that violates the Cigarette and Other Tobacco Products Act (COTPA) and show cause within ten days.

“4mg nicotine gums are sold on prescription but 2mg is given over the counters. This can lead to self-therapy and thus accidental overdose. I had also written a letter to drug control of India to stop over the counter sale,” said Dr SK Arora, head of Delhi’s tobacco control cell.

The ad promoted by the companies and published in a leading daily on February 15 is a violation of section 5 of COTPA (Cigarette and Other Tobacco Products Act) 2003 and as per section 22 of COTPA and is considered a punishable offence. 

"In view of above, you are strictly instructed to immediately withdraw this kind of promotion of Tobaccos from all media & all OTHER places wherever promoted & also clarify your position and to show cause  within 10 days that why appropriate punitive action be not initiated against Directors/Office Bearers of the Inventz Life Sciences & Delvin Formulation  Private Limited as per the provisions under section 5 & section 22 of COTPA, 2003," stated the show-cause notice.
