The accused had brought a girl from West Bengal to Delhi on the false promise of marriage but had sold her at a brothel in New Delhi.
A man, accused of selling a girl to a brothel in New Delhi after abducting her, has been sentenced to ten years in jail by a Delhi court which also awarded three years imprisonment to a woman for running prostitution business. Additional Sessions Judge Kaveri Baweja handed down the ten-year jail term to one Ishraful, who had brought a girl from West Bengal to Delhi on the false promise of marriage but had sold her at a brothel in New Delhi.
While relying on the testimony of the victim, the court said "it has been established from evidence that after bringing the girl to Delhi, Ishraful sold her at a brothel and to my mind her testimony established the charge under section 366 (abducting a woman to compel her for marriage) of IPC beyond reasonable doubt." The court, which noted that the girl who identified Ishraful in court, was one of the 10 victims rescued from the brothel, also imposed a fine of Rs 5,000 on him.
According to the prosecution, on June 25, 2012, a raid was conducted at a brothel in G B Road red light area here in which the police rescued 10 girls and arrested four women - Pooja, Padma, Chanda and Raziya - for sex trade. While relying on the testimony of another victim, the court sentenced Pooja to three years imprisonment for the offence of running prostitution business under Immoral Traffic Prevention Act. It also convicted Raziya for the offence but she was absconding.
"It is borne from victim's statement that a brothel was being run by Pooja and Raziya. Her statement to the effect that Raziya used to force her and other girls into prostitution is unrebutted," the court said.
The court, however, acquitted Chanda due to lack of evidence against her saying, "mere identification of Chanda by one of the girls can't by any stretch of imagination be said to prove any of the allegations against her." The court noted that Chanda was a sweeper at the brothel and lived with her son and both of them were HIV positive patients. It also directed that adequate compensation to all the victims should be decided by the DLSA.
"I recommend payment of adequate compensation to the victims in this case as per CrPC. Quantum of compensation to be awarded under victim compensation scheme shall be decided by DLSA," the judge said.
According to the prosecution, a raid was conducted after police received information that two girls, who were missing from West Bengal, were detained at a brothel in the capital. During the raid, a total of 10 girls were rescued from the brothel here. They were produced before Child Welfare Commission which directed action against the accused persons.
One of the rescued girls told the court that a woman had taken her from West Bengal to Mumbai and then brought her to Delhi on the pretext of getting her a job and sold her to Pooja, who was running prostitution business here. When she refused to work, she was beaten up by them and forced to do sex work.
The police had filed a supplementary charge sheet against Ishraful for the offence of abducting woman to compel her for marriage under the IPC. It had examined 12 witnesses,including six victims, three doctors and three cops. During the trial, the accused denied the allegations saying they have been falsely implicated. Pooja and Raziya had admitted doing the prostitution work voluntarily and said there were other girls also.
All the accused, however, denied purchasing or selling any girl for sex work.
