After a delay of three months, the Centre has finally taken a decision on whether to elevate Justice Akil Kureshi, a sitting judge of the Bombay High Court as Chief Justice of Madhya Pradesh High Court. A recommendation to this effect was made by the Supreme Court Collegium on May 10 but the delay on part of the Centre forced the Gujarat High Court Advocates' Association to file a petition in apex court questioning the delay.

Appearing for Centre, Solicitor General Tushar Mehta informed a bench of Chief Justice Ranjan Gogoi, Justices SA Bobde and S Abdul Nazeer that the Centre has taken a decision and the same shall be communicated to the Collegium within a week. Although the bench asked Mehta to state the decision, Mehta said that he has instructed to state that the matter shall be officially communicated.

Considering the stand of the Centre, the bench said, "The Government may decide and communicate its decision, as stated by the learned Solicitor General." The Court said that the matter will next be listed on a date to be fixed by CJI, upon receipt of Centre's decision.

The petitioner Association had claimed that the names of four other judges as Chief Justices got cleared within a month of being recommended by the SC Collegium, except that of Justice Kureshi. In June, the petitioner association passed a resolution alleging that the appointment of Justice Kureshi was "blocked".
